The state offers a 1% concession on stamp duty for female buyers. Male buyers pay 5% stamp duty, while female buyers pay 4%. Joint ownership rates vary: both female joint owners pay 4%, both male joint owners pay 5%, and a male-female joint ownership attracts 4.5% stamp duty. Registration charges are uniformly 1% with no upper cap.
Assam also charges a small fee for the transfer of property in urban areas under certain municipal jurisdictions. Buyers should also budget for professional fees including lawyer charges, document writer fees, and the cost of obtaining encumbrance and other certificates.
Property Registration Process in Assam
The registration process in Assam is managed through the Revenue and Disaster Management Department's registration system. Here are the key steps:
- Step 1: Engage a legal practitioner to draft the sale deed and verify the title of the property.
- Step 2: Pay the stamp duty either through e-stamping or by purchasing non-judicial stamp paper from authorised vendors. The payment can also be made at designated bank branches.
- Step 3: Book an appointment online at the concerned Sub-Registrar office. The online portal provides availability slots.
- Step 4: Present the deed at the Sub-Registrar office. Both parties must be present with original documents and two witnesses. Thumb impressions and photographs are taken during the process.
- Step 5: After verification and approval by the Sub-Registrar, the deed is registered and the registered copy is returned to the buyer.
